Argentine Senate stalls on banning online gambling ads

More than a year after receiving preliminary approval in the Chamber of Deputies, the bill seeking to prohibit the advertising, promotion, and sponsorship of online gambling in Argentina remains without significant progress in the Senate. Since its introduction in November 2024, the initiative has been referred to four committees, but to date, only the Health Committee has convened debates, which have not led to a definitive vote. Various political sectors and local media warn that the discussion is stalled, pointing to strong pressure from business groups interested in maintaining the current dissemination scheme.

The proposed regulation is one of the most restrictive in the region, as its article 8 explicitly prohibits sponsorship in sports apparel, outdoor advertising, and traditional and digital media. A key point of the text is the veto on welcome bonuses and the participation of influencers in the promotion of these platforms, tools that have been identified as the main channels for attracting new users. Faced with this legislative halt, the Civic Coalition bloc has formally urged senators not to let the preliminary approval lapse, describing problem gambling as a direct threat to the well-being of families and the future of young people.

Political clashes and criminal sanctions against illegal offerings

The delay in the chamber has generated strong criticism of the national government's management. Opposition deputies have accused the Executive of allowing a model that facilitates the indebtedness of thousands of citizens to persist, even suggesting that the lack of regulation favors money laundering structures under the guise of entertainment. In this context, the law not only targets advertising but also toughens penalties from three to eight years in prison for any person or entity that organizes gambling collection systems without the authorization of the competent jurisdictions, seeking to combat the clandestine market at its root.

The scenario for 2026 is complex, as if the Senate does not reactivate the discussion in the remaining committees, the project risks losing parliamentary status. For the iGaming industry, this legislative paralysis represents a tense calm, while civil organizations and mental health specialists redouble pressure for Argentina to have a federal framework that unifies restrictions and protects the most vulnerable sectors from constant exposure to gambling marketing on social media and sports broadcasts.
