San Juan intensifies illegal gambling fight with new regulations
The province of San Juan is in the final stage of activating a robust regulatory framework against unregulated online gambling. The Caja de Acción Social (CAS) has completed the regulation of the law sanctioned at the end of 2024, a document that has undergone a rigorous technical review process over the past seven months. Currently, the initiative has the backing of the Ministry of Economy and is awaiting the signing of the regulatory decree by the Executive Power to formally begin control operations during this year.
Judicial cooperation and criminal prosecution of illegal platforms
The president of the CAS, Juan Pablo Medina, has indicated that the primary objective of this new stage is to establish rigorous oversight that will begin to be implemented in the second half of 2026. To achieve this, the agency will work in coordination with the Public Prosecutor's Office and the State Secretariat of Security and Public Order, focusing on the identification and closure of operators who violate the law. Official estimates indicate that there are approximately 400 online gambling platforms operating without a license in the province, which could face severe penalties including prison sentences of between three and six years, as stipulated in the Penal Code.
The regulation not only focuses on sanctions but also on structuring a transparent market through the creation of a public registry of authorized operators. This registry will include both local licensed companies and those with agreements in other jurisdictions, allowing users to have a legal, secure, and audited offering. The CAS will be responsible for authorizing platforms that meet technical and legal requirements, marking a clear distinction between sites that guarantee responsible gambling and those that operate clandestinely.
A complex administrative process to ensure transparency
The drafting of the regulatory draft has been one of the most significant challenges for the province's technical team. After initial approval by the CAS Board of Directors, the text underwent a thorough review by the Ministry of Economy before being sent to the Government Legal Secretariat for its final drafting. This administrative process seeks to ensure that the implementation of the licensing system and the sustained control scheme are robust enough to withstand the challenges of the digital environment.
Once the decree is officially published, the province of San Juan will have the necessary legal tools to deploy all its inspection capabilities. The implementation of this licensing system not only represents an advance in terms of legal certainty for operators but also reinforces the protection of citizens against digital environments that offer no guarantees regarding their funds or the integrity of their personal data.
