Brazil has already fined 73 betting operators
Just over a year after the launch of the regulated online gambling market in Brazil, the Ministry of Finance has intensified oversight of authorized operators. Since January 2025, the Secretariat of Prizes and Betting has initiated more than 100 administrative sanctioning processes, involving 73 of the 85 companies licensed to operate in the country.
According to information obtained through the Access to Information Law, the investigations arose from approximately 200 oversight actions and have so far resulted in fines of around 11 million reais, about 2.16 million dollars, in addition to dozens of warnings. To date, 39 processes have been definitively concluded, of which 32 ended with warnings and seven with financial fines, while another ten financial sanctions remain pending resolution due to appeals filed by the companies.
Despite the accumulated amount, the sanctions applied represent a small portion of the penalties provided for by Brazilian legislation, which allows for fines of between 0.1 and 20 percent of turnover, with a cap of 2 billion reais per infraction, about 393 million dollars. In the cases resolved so far, the penalties did not exceed 0.5 percent of the revenue of the operators involved. Among the most significant is the one applied to Blaze, penalized with 2.3 million reais, about 451,000 dollars, for disseminating advertising with the participation of children and adolescents. According to the secretariat, the seriousness of the infraction justified the fine even though it was the first process against the company, whose operator in Brazil, Foggo Entertainment, chose not to comment on the case.
Although the regulation contemplates the possibility of definitively canceling an operator's authorization, this measure has not yet been used. The loss of the license would invalidate an authorization whose granting value amounts to 30 million reais, about 5.89 million dollars. The closest case was that of Pixbet, whose authorization was temporarily suspended due to non-compliance related to the registration process on the Consumidor.gov.br platform, although the company regularized its situation and recovered the permit. The operator also obtained an injunction in the Federal Court of Brasília that suspended another decision by the secretariat related to alleged non-compliance with documentation submission deadlines during the authorization process.
The Ministry of Finance indicated that during the fourth quarter of 2026, they will seek to improve supervision and sanction application mechanisms, with the implementation of tools to facilitate the redress of damages suffered by bettors and the strengthening of monitoring of authorized companies. The objective is that, as the regulated market matures, sanctions will be adjusted more precisely to the history of recidivism and the seriousness of the infractions.
