Brazil: Stronger regulatory control & new obligations for operators

The Secretariat of Prizes and Betting (SPA) of the Ministry of Finance took a new step in consolidating the regulated betting market by publishing Normative Instruction SPA/MF No. 35. The regulation establishes clear criteria for reporting operational, corporate, and technological changes, as well as regulating the start of activities of authorized betting houses in the country.

The central objective of the measure is to organize communication between operators and the regulatory authority, ensuring greater transparency, protection for bettors, and traceability in a market that is still in full implementation phase.

Changes that require prior authorization

The new instruction distinguishes those modifications that can only be applied after the express approval of the SPA. This group includes changes in trademarks, betting modalities offered, domains used, and providers of technological platforms.

In these cases, operators must submit formal requests accompanied by technical and operational documentation, such as system certifications, business continuity plans, and personal data protection policies. The authority will evaluate whether the modifications preserve the security of funds, operational stability, and users’ rights.

Modifications with immediate effect

The regulation also contemplates changes that may take effect immediately, although they must be reported within specified deadlines. These include the replacement of financial or payment institutions, changes of administrators, variations in corporate name, relocation of headquarters, corporate reorganizations such as mergers or spin-offs, and alterations in shareholding control.

In these cases, the general notification deadline is up to 10 days, while more complex corporate operations may be communicated within a maximum period of 30 days. The SPA also requires that the start of operations be reported in advance, even when the launch of brands under the bet.br domain is carried out gradually.

Protection of the bettor and SPA’s powers

The regulatory body emphasized that all provisions are aimed at preserving the integrity of financial balances, the security of personal information, and the transparency of operations. In situations that may pose risks to users, the SPA reserves the power to grant conditional approvals, request additional documentation, or review authorizations already granted.

The authority points out that this preventive approach seeks to avoid service interruptions and ensure that any relevant change is evaluated under uniform standards.

Channels and administrative deadlines

Communications must initially be made through the Electronic Information System (SEI), although the SPA anticipated that at a later stage the process will migrate to the Betting Management System (SIGAP). The maximum deadline for analyzing requests will be up to 150 days, with the possibility of suspension if clarifications or additional information are required.

With this new instruction, Brazil continues refining its regulatory framework and sends a clear signal to the market: online betting operations must be developed under strict rules, with updated information and permanent supervision by the State.
