The Federal Public Ministry analyzes betting oversight
The Federal Public Ministry of Brazil has opened a civil investigation to assess how the government of Luiz Inácio Lula da Silva is supervising the regulated online gambling market. The measure, formalized on May 31, will initially last one year and opens a new line of control over the work of the Ministry of Finance and the Secretariat of Prizes and Betting, at a time when the regulated sector coexists with political pressures to tighten the framework, ban iGaming, or redirect its revenue.
The investigation originated from a previous administrative procedure, which aimed to verify the routines and mechanisms that the Treasury uses to oversee compliance with legislation by authorized bookmakers. By transforming this procedure into a formal inquiry, the MPF expands its investigative powers and is authorized to request documentation, data, and statements from both the federal government and the operators of the regulated fixed-odds market themselves.
Two simultaneous fronts: control and public health
The case opened by the MPF will focus on two main axes. The first will analyze whether the Treasury is adequately fulfilling the obligations imposed by Law 14.790/2023 and Law 13.756, the two norms that underpin the current Brazilian online gambling framework. The inquiry will assess whether the control, monitoring, and sanction mechanisms applied to authorized operators are sufficient to ensure regulatory compliance and prevent the advancement of the parallel market.
The second axis focuses on the public health system's response to problem gambling. The MPF will evaluate whether current public policies are reaching people who develop risky behaviors and whether the healthcare network has the effective capacity to address cases. This approach reflects a growing concern in Brazil, where recent studies show a significant increase in consultations related to disorders derived from digital gambling, especially among young people and low-income users.
Twelve months of data collection and political weight
Over the next twelve months, the MPF will collect data and documentation to determine whether the regulation, control, and healthcare policies related to the sector are being adequately implemented. The inquiry does not yet imply the imputation of responsibilities, but it opens the door for the body, once concluded, to present recommendations, sign conduct adjustment agreements, or promote public civil actions against the State itself.
The new case comes at a delicate time for the Brazilian market. In recent weeks, different sectors of Congress have promoted projects to allocate part of gambling revenue to nursing homes, health, and public safety, while initiatives to ban iGaming are advancing. For the region, the MPF's scrutiny of oversight is a relevant signal: it shows that the sustainability of the regulated model in Brazil depends not only on the Executive but also on how control bodies evaluate it, in a key market for the entire iGaming ecosystem in Latin America.
