SPA wants to regulate online gaming providers
The regulation of the online betting market in Brazil has been in effect since January of this year and already establishes obligations for operators, game certification, technical standards, and operational parameters for authorized platforms. However, a central point remains without regulatory definition: the regulatory framework for online game providers, responsible for developing and distributing content both to licensed betting houses and to sites and platforms in general.
Today, these providers operate without their own regulation that defines their commercial role within the regulated ecosystem.
Providers without clear commercial rules
Currently, providers must meet suitability, technical certification, audit, and security protocol requirements. These mechanisms ensure the proper functioning of the games, but there is no specific regulation that governs their commercial relationship with authorized or unauthorized operators.
Without that framework, a game certified for regulated environments can end up available on unauthorized platforms, since there are no administrative tools to control the actions of those who distribute the content. In practice, there is regulation for the product, but not for the provider.
How game offerings to platforms work today
There is no regulation that sets criteria for a provider to offer their games to platforms without a license from the Secretariat of Prizes and Bets (SPA). According to the Ministry of Finance, this gap will be addressed in the 2025-2026 Regulatory Agenda, which will include a specific ordinance to regulate the matter.
The future regulation should establish:
- how providers will be able to operate in Brazil,
- what commercial and technical requirements will be,
- and what obligations they must fulfill in the fight against the illegal market.
Until that text is published, providers continue to be governed only by the technical requirements already in force.
Oversight limited to platforms, not content
Current oversight focuses on the operation of irregular sites. The SPA monitors search engines and social networks, requests Anatel to block platforms, and demands the removal of pages and posts related to unauthorized betting.
These measures affect the operation of illegal sites, but do not directly reach those who supply the content that feeds those platforms. The Ministry of Finance acknowledges that the new rules will be essential to regulate that flow and curb the offering of games in unregulated environments.
For now, there is no defined date for the publication of the regulation that will govern providers.
