Chile: Court demands ISPs disclose blocking online betting sites
The Santiago Court of Appeals ordered the main Internet providers in Chile, Claro, Entel, GTD, Movistar, WOM, and VTR, to detail whether they have complied with the Supreme Court's instruction to block access to online betting sites classified as illegal in the country.
According to local media reports, the resolution requires the companies to report “within five days” on the measures taken to execute the ruling, warning that, in case of non-compliance, the court may apply the sanctions it deems appropriate.
The order was issued by the Protection Account Chamber, composed of Minister Iara Barrios M., substitute Minister Fernando Valderrama M., and member lawyer Rafael Plaza R.
Background of the ruling
In September, the Supreme Court instructed the “immediate and effective” blocking of online betting platforms, accepting a protection appeal filed by Lotería de Concepción against telecommunications operators.
The highest court thus overturned the decision of the Santiago Court of Appeals, which in May had rejected blocking the sites.
The supreme ruling reiterated that gambling is prohibited in Chile as a general rule and that only authorized entities — Lotería de Concepción, Polla Chilena, the racetracks, and casinos — can legally operate them. Regarding remote gambling, the court recalled that only Lotería, Polla, and Teletrak are authorized to operate certain online products.
