Coljuegos: Online gaming bonus limits to public consultation
The Colombian regulator Coljuegos opened a draft resolution for comments that establishes limits on the issuance of promotional bonuses in online gaming. The measure aims to correct the negative effects of excessive use of bonuses on the settlement base of exploitation rights, which finance the health system.
The draft proposes two application scenarios:
a) Operation with VAT: bonuses converted into credits may not exceed 1.6% of the gross income of the month.
b) Operation without VAT: the maximum monthly value will be equivalent to the average of one month of exploitation rights paid in the previous twelve months.
For new operators, during the first year the cap will be one twelfth of the fixed exploitation rights of the first year. From month 13, the general regime will apply.
The resolution will be mandatory for all online gaming concessionaires in the country, and non-compliance may result in fines, pecuniary sanctions, unilateral termination, or contract expiration.
