Spain: Online gambling ads must warn of addiction risks
The Directorate General for the Regulation of Gambling (DGOJ), under the Ministry of Consumer Affairs of Spain, has initiated a public consultation process to approve a new resolution that will modify the commercial communication rules for the online gambling sector.
The most significant change is the requirement to include messages warning about the harmful effects of gambling addiction or risky behaviors, replacing the traditional text that only appealed to “responsible gambling.” The measure aims to strengthen consumer protection and prevent the emergence of addictive behaviors, aligning with the principles of Law 13/2011 regulating gambling.
The project will also update the criteria regarding the form, size, contrast, and placement of messages established in Royal Decree 958/2020, which regulates commercial communications for gambling. These new conditions will seek to ensure greater visibility and understanding of the warnings by the public, both in digital and audiovisual formats.
During the public information process, any person or entity can submit observations or suggestions about the proposal. The deadline to send contributions will remain open until November 26, 2025, and they can be sent to the official email dgoj.sgregulacion@ordenacionjuego.gob.es
The DGOJ emphasizes that this resolution is framed within the mandate of Law 13/2011, whose purpose is to guarantee a secure legal framework for state gambling activity, protect the public interest, and ensure the safeguarding of consumers.
With this initiative, Spain takes another step in the responsible regulation of the gambling sector, incorporating warnings similar to those already existing on products such as tobacco or alcohol. The measure reinforces the Government’s approach toward a more controlled advertising environment that is aware of the risks associated with problematic gambling.
