Panama gambling law: Biometrics, ad curbs, problem prevention
The National Assembly of Panama has set a regulatory precedent in the region by approving Bill 403 in its third debate. This legislative initiative establishes a comprehensive framework for the prevention, control, and treatment of problem gambling, responding to the rapid growth of digital betting and the need to implement more robust supervision mechanisms. The law, promoted by deputies Raúl Pineda and Crispiano Adames, places special emphasis on responsible gambling and the protection of the most vulnerable sectors of society.
The new legal framework introduces technical and financial obligations for operators that seek to ensure that the industry's development does not compromise the mental health of citizens. Among the most notable measures is the creation of a specific fund for the treatment of gambling addiction, which will be financed by mandatory contributions from casino companies and digital betting platforms. These resources will be administered by the Institute of Mental Health (INSAM) to strengthen care programs and finance the opening of a specialized center with national coverage.
Biometric verification and protection of minors
To combat access by minors to gambling platforms, the law requires the implementation of biometric verification systems across all digital channels. This technological requirement aims to reinforce identity controls and ensure that only duly registered adults can participate in betting activities. The regulation is explicit in prohibiting the presence of minors in both physical establishments and virtual gaming environments.
In line with global regulatory trends, the approved text imposes severe restrictions on commercial communication. Gambling advertising will be limited on social media, traditional media, and at sports events. Furthermore, the use of public figures or influencers to promote or encourage participation in gambling is explicitly prohibited, seeking to reduce the impact of these messages on the young population.
Oversight and sanctioning regime
The Gaming Control Board (JCJ) will be the authority responsible for ensuring strict compliance with this law, working in coordination with other state agencies. To this end, the regulator will have new technological tools that will allow real-time monitoring of the sector's activity.
The sanctioning scheme provided for those who violate the norm includes:
- Administrative financial penalties.
- Temporary or definitive suspension of operating licenses.
- Criminal proceedings in cases where serious or repeated non-compliance is detected.
Deputy Raúl Pineda highlighted that this law represents a fundamental step forward in balancing the right to entertainment with social security, ensuring that the Panamanian market operates under standards of integrity and transparency. With the enactment of this project, Panama seeks to position itself as a benchmark in the implementation of safe gambling policies in Central America.
