Nevada effect: NGCB sues Polymarket, sets red line for prediction
The predictive markets industry faces its most rigorous challenge to date. The Nevada Gaming Control Board (NGCB) has formalized a civil enforcement action in the Carson City district court against Blockratize Inc., the parent company of Polymarket. The goal is clear: to force the platform to cease any activity that the state classifies as unlicensed sports betting.
This legal move, revealed by specialized jurist Dan Wallach, underscores Nevada’s uncompromising stance: any product that allows betting on the outcome of an event must be subject to the state’s regulatory framework, with no exceptions for the use of blockchain technology or "event contract" models.
The Integrity Argument: The "General Welfare"
The NGCB has based its lawsuit on protecting the state’s economic ecosystem. For the regulator, allowing platforms to operate outside the licensing framework is not only a legal violation but a threat to the public health and order that has been so hard to build in the world’s gambling capital.
The Kalshi Precedent and the Regional Clampdown
The offensive against Polymarket is not an isolated event. Nevada already achieved a strategic victory in November after overturning a court decision that favored Kalshi, enabling a cease and desist order on its sports contracts.
Adding to this scenario is the recent action by the Tennessee Sports Betting Council, which on January 9 also issued cease and desist orders against Polymarket, Kalshi, and Crypto.com. This pattern suggests a coordinated move among state regulators to regain control over predictive markets attempting to operate under financial or decentralized structures.
Between Wall Street and State Regulation
The paradox of the case is its timing. Polymarket has just finalized its official return to the U.S. market after a long period of exclusion, backed by a massive USD 2 billion investment led by actors linked to the New York Stock Exchange.
This backing from Wall Street’s major capital seems to clash head-on with the interpretation of gaming regulators. While for financial investors Polymarket is a price discovery platform, for Nevada it remains a bookmaker.
