The NBA negotiates with the CFTC and not with gambling regulators

The most revealing institutional detail of the NBA's announcement is not the names of the platforms, but rather that of the agency with which the league signed a memorandum of understanding. It was not a state gaming commission: it was the Commodity Futures Trading Commission, the U.S. federal derivatives regulator. That detail encapsulates why prediction markets are not being discussed as a form of sports betting, but as something else entirely.
The league designated Kalshi and Polymarket as its preferred prediction market platforms and established a framework with them for NBA-related contracts. The memorandum with the CFTC aims to structure cooperation and the flow of information regarding contracts involving the league, which in practice means that integrity monitoring is coordinated with a financial instruments regulator rather than the gambling oversight circuit.
The obligations assumed by both platforms are what matter for integrity purposes. They face limits on which markets they can offer, must share information when an investigation or suspicious activity arises, and neither team nor league personnel are permitted to trade contracts tied to their games. These three clauses replicate the playbook leagues already use with their authorized sportsbooks, transplanted into an environment regulated as a futures market.
In exchange, Kalshi and Polymarket secure promotional opportunities across U.S. media channels, marketing rights, and the use of NBA intellectual property. They will also receive official league data via Sportradar, its data distribution partner, and will use it to manage and settle authorized markets.
That last point deserves attention because it turns the agreement into something more than a sponsorship. A prediction contract is settled against an outcome, and whoever provides the official data determining the settlement holds a position equivalent to a pricing source in a financial derivative. The league not only authorizes the markets: it also controls, via Sportradar, the input by which they are settled.
Scott Kaufman-Ross, NBA Head of Media Distribution and Partnerships, stated that protecting the integrity of the game is the top priority and that with an emerging category, constructive collaboration alongside regulators and operators is essential to ensure "appropriate safeguards" are in place. He framed the agreements as a step forward in protections for a nascent category that simultaneously enables new ways to engage with fans.
Adam Barrick, Head of Sports Partnerships at Kalshi, emphasized the nationwide consumer protection framework that, according to him, explains why millions of people trade on the platform. Ari Borod, President of Sports Business Development at Polymarket, said that their users will be able to engage deeper with basketball and spoke of building a secure and transparent ecosystem.
The league also expanded its agreement with DraftKings to cover prediction markets and nationwide promotion, and announced that in the coming weeks it will do the same with other operators and the rest of its official sports betting partners. The result is a league that will simultaneously have sportsbook partners and prediction market partners under a single integrity umbrella, with reinforced obligations specific to this category and restrictions aligned with its most recent rules on sports betting.
The discussion regarding the classification of these products reached Latin America this month. At the International Association of Gaming Regulators conference in Lima, prediction markets had their own panel, where regional regulators raised the difficulty of categorizing them, following their earlier inclusion by the Corporación Iberoamericana de Loterías y Apuestas de Estado in its 2027 working agenda. The NBA's move provides these regulators with a concrete precedent: in the world's largest market, the institutional counterpart for a sports prediction market is the derivatives regulator.
Kalshi is an event market regulated as a designated contract market by the Commodity Futures Trading Commission, allowing it to offer contracts on verifiable outcomes to U.S. users. Polymarket operates prediction markets based on contracts settled against the outcome of future events. Sportradar is the NBA's official data distribution partner and provides the information used to settle the league's authorized markets.
