Birigui (SP) Approves Municipal Lottery, Ops Start 2026
The Municipal Council of Birigui (São Paulo) approved the creation of a local lottery that would begin operating in 2026. The initiative, promoted by Mayor Samanta Borini, aims to increase revenue without raising taxes and to finance essential areas such as health, education, security, and sports. The operational model is yet to be defined.
The municipality of Birigui, in the interior of São Paulo, took a decisive step towards implementing its own lottery. The Municipal Council approved the bill presented by Mayor Samanta Borini (PSD), which proposes the Municipal Lottery as an alternative to increase public revenue without raising the tax burden on the population.
With legislative approval, the local administration will now begin legal, technical, and financial studies to define the operational model. Among the alternatives under evaluation are direct management by the City Hall or concession to a specialized company through public bidding. The expectation, according to the City Council, is that the lottery will start operating in 2026.
Destination of funds and control mechanisms
The regulation establishes that all proceeds must be exclusively allocated to areas considered priorities:
- health,
- education,
- security,
- social assistance,
- culture, and
- sports.
Additionally, the operation will generate additional income for the municipality through the application of a 5% ISS tax on gross revenue.
To ensure transparency, the law mandates periodic audits conducted by the Internal Audit of the City Hall and the publication of reports on the Transparency Portal. The Planning and Finance Secretariat will be responsible for overseeing all activity.
A fiscal strategy without tax increases
Mayor Samanta Borini celebrated the approval and highlighted the potential impact of the new revenue tool:
“The Municipal Lottery is a modern and responsible alternative that allows us to increase investments in essential areas without raising taxes.”
The Executive now has a period of 90 days to regulate the law and begin formal procedures for implementation.
Pending national definition
Despite local progress, the operation of municipal lotteries in Brazil still depends on the decision of the Supreme Federal Court (STF). The ADPF 1212, which analyzes whether municipalities can autonomously operate lotteries, was sent to the Attorney General’s Office in September 2025 and remains under evaluation.
Until a definitive decision exists, several Brazilian cities maintain similar projects in the preparatory phase, awaiting the STF’s position.
