Brazil opens consultation to renew licensing rules
The Secretariat of Prizes and Betting of Brazil's Ministry of Finance has opened a public consultation to gather contributions for drafting new rules for authorizing fixed-odds betting operators in the country. The process will remain open for 45 days, between July 27 and September 9, and will allow participation from individuals and legal entities through the Brasil Participativo portal.
The contributions will serve as the basis for a new ordinance that will establish the conditions and requirements that companies interested in obtaining a license to commercially operate sports betting and online gaming regulated in Brazil must meet. As explained by the agency, the objective is to improve the current authorization procedure and incorporate lessons learned from the first cycle of licenses granted since the regulated market came into effect. The initiative is part of the secretariat's Regulatory Agenda and includes the review of the procedure established by SPA/MF Ordinance number 827/2024, which regulated the conditions for obtaining authorizations under Laws 13.756/2018 and 14.790/2023.
Once the consultation period closes, all received proposals will be analyzed by the secretariat before the final text of the new regulation is drafted. The opening of the process comes just days after the Ministry of Finance announced the creation of a working group aimed at strengthening the transparency of administrative processes linked to operator authorizations.
This task force, composed of 15 officials from different areas of the ministry, will have the mission of reviewing files before their publication, identifying sensitive information, and ensuring compliance with information access criteria. The measure is part of the Government's commitment to make more than 25,000 documents related to licensing processes available to the public.
As of January 1, 2025, only operators previously authorized by the Ministry of Finance can offer betting in the Brazilian market. With this new public consultation, the Government seeks to continue improving the licensing system and consolidate the development of the regulated market, with clearer rules and greater legal certainty for operators.
