Brazil: Senate debates gradual tax hike for fintechs & betting until

The Senate once again placed the tax burden of fintechs and fixed-odds betting platforms at the center of the debate. The project rapporteur, Senator Eduardo Braga (MDB-AM), presented his report this Wednesday (26) before the Economic Affairs Commission (CAE), confirming a gradual tax increase until 2028, in line with the technical design of the original text.

Fintechs: CSLL will rise from 9% to 15% in three years

The opinion proposes that the Social Contribution on Net Profit (CSLL) applied to fintechs — currently at 9% — advance to 12% in 2026 and reach 15% in 2028.

The staged progression is defended by the rapporteur as a way to provide predictability to the digital financial sector, one of the fastest growing in Brazil in recent years.

Online betting: GGR will go from 12% to 18%

For the sports betting and online gaming market (bets), the report establishes a similar increase:

Currently, the rate is 12%. The idea is that the adjustment be gradual to avoid a sudden impact on operators who have just entered the regulated market.

Fiscal impact and government objective

The Minister of Finance, Fernando Haddad, estimated that the proposal would have an impact below R$ 5 billion on public accounts in 2026.

The Executive considers that this progressive increase helps strengthen revenue collection without slowing economic activity and supports the goal of zero deficit in 2025 and primary surplus in 2026.

The initiative comes after the political wear caused by MP 1303/2025, rejected by Congress and harshly criticized by the market. That measure sought to modify the taxation of financial investments and crypto assets but faced strong parliamentary resistance. The new project is articulated as a negotiated alternative to restore revenues without reactivating the crisis generated by the MP.

Fiscal debate: fintechs and betting at the center of the discussion

The report places fintechs and bets as two of the sectors with the greatest revenue potential. The government maintains that tax progressivity is essential to correct distortions, avoid abrupt jumps, and maintain a stable tax framework.

The opposition, however, questions the timing of the increase, arguing that it could affect the expansion of the Brazilian digital ecosystem. After the reading of the report, Senator Rogério Marinho (PL-RN) requested more time to analyze the text, which is why the CAE postponed the vote to Tuesday, December 2.
