CazéTV denies before Senacon that commenting on odds is advertising
CazéTV responded to Brazil's National Consumer Secretariat (Senacon), an agency of the Ministry of Justice and Public Security, stating that commentators' and analysts' remarks about sports odds during the 2026 World Cup do not constitute gambling advertising. According to Folha de S.Paulo newspaper, the defense was filed on June 30 and made public on Monday, July 6.
The channel, owned by LiveMode and broadcasting World Cup matches on YouTube, is under investigation by Senacon for suspected abusive practices in promoting betting platforms during broadcasts. The investigation began on June 24, after questions arose about how sportsbooks were presented on screen, including promotional offers tied to specific matches. In parallel, the National Council for Advertising Self-Regulation recommended suspending ads from Betnacional, bet365, and KTO.
In its defense, the broadcaster denied any wrongdoing and stated that its advertising insertions respected the limits of the products offered by operators, including mechanisms for identifying the advertisement, warnings about responsible gambling, and age restrictions. At the same time, it admitted that the spontaneous and integrated format of its broadcasts, with natural interaction between hosts and content, could create a more immersive perception of advertising for the audience.
The central argument of the defense is the distinction between the sports analysis of its commentators and the pieces contracted by sportsbooks. For CazéTV, comments on a player's performance or the probability of a result are part of journalistic freedom of expression and the usual language of a sports broadcast, and should not be confused with advertising when there is no defined commercial offer or formal elements identifying the content as an advertisement.
The discussion covers incidents highlighted in parallel investigations. In one of them, after a bet365 advertisement, former player Ju Cabral commented that there was a high probability that a certain odd would be met. For Andiara Maria Braga Maranhão, general coordinator of Responsible Gambling Monitoring at the Ministry of Finance, this case could mislead the viewer, as the broadcast team's comment could be read as a validation of the bet. In another episode, during the match between Argentina and Austria, commentator Luis Felipe Freitas mentioned an improved odd for Lionel Messi to score in the second half, as part of a Betnacional promotion.
Even before filing its defense, CazéTV had already modified the format of its advertising activations during the group stage and, among other changes, stopped mentioning odds while matches were being played.
