Fux suspends blocking of social program users on betting platforms
The minister of the Supreme Federal Court (STF), Luiz Fux, rapporteur of the Direct Action of Unconstitutionality (ADI) No. 7,721, decided to partially grant the precautionary measure requested by the National Association of Games and Lotteries (ANJL), temporarily suspending the mandatory blocking of already active accounts belonging to beneficiaries of social programs.
The decision establishes the suspension of the operational obligations that imposed the blocking and compulsory closure of accounts of users benefiting from programs such as Bolsa Família and the Continuous Cash Benefit (BPC), until a conciliation hearing is held.
In practical terms, this means that users who have been blocked between December 1 and this Friday the 19th may have the restrictions lifted and resume operations on the platforms, provided their accounts were already active before the measure.
The prohibition on new registrations remains
Despite the partial suspension, Minister Fux upheld the prohibition on making new registrations or opening new accounts for beneficiaries of social programs, in accordance with the provisions of Normative Instruction No. 22/2025 of the Secretariat of Prizes and Bets of the Ministry of Finance (SPA-MF).
“I partially grant the precautionary request so that, until the scheduled conciliation hearing takes place, the effectiveness of the operational obligations that imply the blocking and compulsory closure of already active accounts is suspended, maintaining the prohibition on making new registrations or opening new accounts,” states the text of the decision.
Conciliation hearing was brought forward
The STF also decided to advance the conciliation hearing, which was initially scheduled for February 17, 2026. The new date set is February 10, 2026, when the appropriate way to comply with the precautionary measure and the next regulatory steps will be analyzed.
For its part, the ANJL reported that it will continue to act institutionally and technically in defense of the regulated market, and that it will keep its associated companies informed about any new developments related to the case.
