Ecuador establishes guidelines for applying 15 percent VAT to betting

The Internal Revenue Service of Ecuador has taken a fundamental step towards the tax formalization of the digital ecosystem by defining the technical criteria for the application of a 15 percent Value Added Tax. This measure directly affects online betting and sports forecasting platforms, seeking to capture tax revenue from a constantly expanding activity and align the country with regulatory trends observed in other markets in the region. Through Circular number NAC-DGECCGC26-00000004, the collecting agency specified that all services provided via the internet or technological platforms that operate automatically and with minimal human intervention will be subject to this current general rate.

A comprehensive scope over the online gaming ecosystem

The new provision is not limited solely to traditional sportsbooks but covers a broad spectrum of digital services related to entertainment and sports. This taxed universe specifically includes the dissemination of bets, sports forecasts, online video games that require a pay-per-use model, and the streaming of sports events. In this way, the SRI eliminates any regulatory gray areas that would allow evasion in iGaming-related activities, consolidating a clear tax base for operators offering their services within Ecuadorian territory.

Technical differentiation based on operator residency

One of the central points of the regulation is the distinction in tax payment responsibility, which varies depending on the tax residency of the service provider. For operators residing in Ecuador, the obligation is direct and traditional: they must issue the corresponding sales receipts, pass on the VAT to the final consumer, and assume full responsibility for declaration and payment to the SRI. This scheme ensures that local companies operate under a framework of fiscal transparency and regulated competition.

In the case of non-resident operators, the Ecuadorian tax authority has established two control mechanisms to ensure collection in cross-border transactions:

Progress in formalization and active fiscalization

This measure represents a significant advance in the modernization of the national tax system in the face of the challenges of the digital economy. By assigning a strategic role to financial intermediaries, the Government strengthens its collection mechanisms, especially in international operations, one of the historical challenges for tax authorities in the gaming sector. The SRI has reminded non-resident providers that they must comply with declaration rules even in cases of voluntary registration, and anticipated that it will exercise strict controls to verify the correct application of the tax, suggesting a much more active approach to fiscalization of the sector starting this year.
