Finance ministry consults on B2B gaming exclusive licenses
The Secretariat of Prizes and Bets (SPA) seeks to end the "double-dealing" of software developers. The new regulation will require game studios to certify that they do not supply clandestine websites if they want to operate in the regulated market.
Brazil's Ministry of Finance has decided to cut off the technological supply to the black market. In a strategic move to shield the legal gaming ecosystem, the Secretariat of Prizes and Bets (SPA) has launched a public consultation to define, for the first time, the technical and operational requirements that B2B service providers must meet.
The initiative aims to address a critical gap in Law 14,790. While fixed-odds betting operators and management platforms are already subject to strict controls, content providers (slot studios, crash games, and live casino) have so far operated in a gray area. This lack of specificity allowed the same company to simultaneously supply legal sites under the "bet.br" domain and unauthorized offshore operators.
End of the double window: Providers must choose their side
The central objective of the upcoming regulation is to establish a principle of regulatory exclusivity. According to the SPA/MF Public Consultation Notice No. 1/2026, the government intends that the certification of a provider's operational capacity be conditioned on its ethical behavior in the market.
This means that, to sell their games to legal operators such as Betano or Rei do Pitaco, developers must demonstrate that they have no commercial ties with illegal platforms operating outside the Ministry of Finance’s oversight. This measure transfers part of the monitoring responsibility to the supply chain, forcing software giants to clean up their client portfolios if they do not want to lose access to the largest regulated market in Latin America.
Deadlines and participation on the Participative Brazil Portal
The consultation process will be open for a period of 45 days, running from February 4 to March 23, 2026. During this window, any individual or legal entity may submit their technical suggestions through the government’s digital system.
Once the proposal submission period closes, SPA technicians will group the contributions by thematic affinity to draft the final ordinance. This procedure is governed by the transparency criteria of Decree No. 12,002, ensuring that the private sector has a voice in drafting the rules that will govern their commercial activity.
New leadership at SPA and the 2026 Regulatory Agenda
The signing of this notice also marks the beginning of Daniele Correa Cardoso’s tenure as acting secretary of Prizes and Bets. The official took operational control of the agency following the departure of Regis Dudena, who moved to functions within the Secretariat of Economic Reforms.
This public consultation is a fundamental pillar of the Ministry of Finance’s 2025-2026 Regulatory Agenda. By regulating providers, Brazil aligns itself with high-surveillance jurisdictions such as the United Kingdom or Romania, where the B2B provider license is as critical as the B2C operator license to guarantee game integrity and end-user protection.
