DGOJ submits new risk detection model to TRIS system
The Directorate General for the Regulation of Gambling (DGOJ) sent to the European Commission, through the TRIS system, the Draft Resolution that defines the new Risk Behavior Detection Mechanism in gambling. The initiative complies with the framework established by the Royal Decree that develops safer gambling environments in Spain.
According to the regulator itself, the project responds to the central objectives of Law 13/2011, regulating gambling, which prioritizes the prevention of addictive behaviors, the protection of vulnerable players, and the defense of consumer rights.
A common framework for all operators
In development of said law, Royal Decree 176/2023, of March 14, introduced the obligation for operators to adopt mechanisms and protocols capable of identifying risky gambling behaviors, based on objective criteria and indicators that allow detecting problematic activity patterns. Article 24 of the regulation also establishes that the regulatory authority may define by resolution the specific detection mechanisms and action protocols that must be applied once these behaviors are identified.
The third final provision of the royal decree set a maximum period of two years from its entry into force for the DGOJ to develop a detection system mandatory for all authorized operators.
Homogeneous criteria and unified categorization
The project submitted to TRIS aims to establish a common mechanism for detecting risk behaviors, with homogeneous criteria and thresholds, which must be applied mandatorily by all gambling operators. The objective is to guarantee a uniform categorization of players at risk, regardless of the platform or operator in which they participate.
In this way, the DGOJ seeks to strengthen responsible gambling policies and ensure an equivalent level of protection for users throughout the regulated market, advancing towards a more coherent, preventive system focused on consumer protection.
