Peru's Indecopi sanctions a sportsbook over a prize
The Consumer Protection Commission No. 2 of Peru's National Institute for the Defense of Competition and the Protection of Intellectual Property confirmed a sanction against Interplay Word, the company operating the online sports betting platform DoradoBet, for failing to acknowledge payment for a series of bets a user had won. The body ruled that the company must pay 14,850 soles, approximately 4,350 dollars, to the consumer as a corrective measure, in addition to maintaining a fine of 3.49 tax units, equivalent to 19,195 soles, approximately 5,620 dollars, for not providing an adequate service.
The conflict originated from a match between Los Chankas and Comerciantes Unidos in Peruvian football, in which the user placed five bets using the bet builder feature. In this case, the bet included that a Los Chankas player would make more than 2.5 shots during the match, meaning at least three shots. According to the claimant, the condition was met, but the platform rejected the payment, considering that the footballer had only made two shots.
To justify its decision, the operator presented records from sports platforms such as ESPN, Sofascore, and Flashscore, which counted two shots from the player. However, during the analysis of the case file, the body reviewed the official broadcast of the match and concluded that the player had made four shots, with plays identified minute by minute. It also noted that the data used by the company did not detail the criteria applied to discard other actions by the footballer, thus deeming that the company had not sufficiently accredited the reason for the rejection.
Each of the bets placed by the user had been for 660 soles, approximately 193 dollars, and generated an individual profit of 2,970 soles, approximately 870 dollars, so the company must pay 14,850 soles corresponding to the winnings obtained. The resolution corresponds to the second and final administrative instance of the body, although the company can still appeal the decision through judicial channels.
